La Fondazione Senabil per la Gioventù e lo Sviluppo (مؤسسة السنابل للشباب و التنمية), di seguito denominata “Senabil” o “la Fondazione”, consente l’accesso al presente sito web (www.senabil-pal.org) e a tutti i relativi sottodomini (il “Sito”), nonché il loro utilizzo, alle condizioni di seguito riportate.

1. Chi siamo

La Fondazione Senabil per la Gioventù e lo Sviluppo è un’organizzazione non governativa senza scopo di lucro registrata in Palestina con numero di registrazione QR-0326-F. La sua sede centrale si trova in Turchia.

Ai fini dei presenti Termini, per “contenuti” si intende qualsiasi materiale pubblicato sul Sito, inclusi, a titolo esemplificativo e non esaustivo, testi, video, elementi grafici e contenuti audio.

2. Privacy e protezione dei dati

La Fondazione rispetta la privacy dei visitatori del Sito, dei donatori e dei beneficiari. Nel corso dell’utilizzo del Sito, la Fondazione può pertanto trattare un numero limitato di dati personali, necessari al funzionamento del Sito, alla gestione delle donazioni e alla risposta alle richieste di informazioni. Le modalità con cui la Fondazione raccoglie, utilizza, conserva e protegge i dati personali sono descritte in dettaglio nell’Informativa sulla privacy. La Fondazione non vende né cede in locazione dati personali a terzi.

3. Utilizzo del Sito

L’utente si impegna a utilizzare il Sito esclusivamente per finalità lecite e in modo tale da non violare i diritti di terzi né limitare o impedire ad altri l’utilizzo e la fruizione del Sito.

Sono vietate, in particolare, le seguenti attività:

  • utilizzare il Sito in violazione della normativa palestinese o internazionale applicabile;
  • tentare di ottenere l’accesso non autorizzato ai server, alle banche dati o ai sistemi della Fondazione;
  • introdurre virus, trojan, worm, bombe logiche o altro codice dannoso;
  • effettuare scraping, data mining o utilizzare sistemi automatizzati per estrarre contenuti;
  • pubblicare o trasmettere materiale diffamatorio, osceno, offensivo o illecito;
  • assumere l’identità di qualsiasi persona o ente.

4. Diritti di proprietà intellettuale

a. Titolarità: tutti i contenuti presenti sul Sito – inclusi testi, elementi grafici, loghi, icone, immagini, contenuti audio, video e software – sono di proprietà della Fondazione Senabil per la Gioventù e lo Sviluppo o dei suoi fornitori di contenuti e sono protetti dalla normativa palestinese e internazionale in materia di diritto d’autore.

b. Utilizzo consentito: l’utente può visualizzare, scaricare e stampare i contenuti per uso personale e non commerciale, a condizione che non rimuova alcuna indicazione relativa al diritto d’autore o ad altri diritti di proprietà.

c. Utilizzo vietato: all’utente è fatto divieto di:

d. Segnalazione di violazioni: qualora l’utente ritenga che i propri diritti di proprietà intellettuale siano stati violati, è invitato a contattare la Fondazione utilizzando i recapiti indicati nella Sezione 11.

  • ripubblicare, riprodurre o distribuire i contenuti per finalità commerciali senza previo consenso scritto;
  • modificare, adattare o creare opere derivate;
  • utilizzare il logo o il nome della Fondazione senza espressa autorizzazione.

5. Donazioni

a. Elaborazione dei pagamenti: quando l’utente effettua una donazione tramite il Sito, il pagamento viene elaborato in modo sicuro da un fornitore di servizi di pagamento terzo di fiducia. La Fondazione non conserva i dati completi della carta di pagamento dell’utente e raccoglie e tratta esclusivamente i dati personali necessari per elaborare la donazione, comunicare con l’utente in merito alla stessa e migliorare i propri servizi. La Fondazione non vende né cede in locazione i dati dei donatori a terzi.

b. Rimborsi: le donazioni sono, di norma, non rimborsabili. Qualora l’utente ritenga che si sia verificato un errore, è invitato a contattare la Fondazione entro 14 giorni.

c. Utilizzo dei fondi: le donazioni sono destinate al sostegno dei programmi umanitari della Fondazione a Gaza. Qualora le donazioni raccolte per un determinato appello superino l’obiettivo prefissato, la Fondazione destinerà l’eccedenza laddove il bisogno è maggiore.

d. Minori di 18 anni: la Fondazione non svolge attivamente attività di raccolta fondi rivolte a persone di età inferiore ai 18 anni.

6. Link a siti web di terzi

Il Sito può contenere link a siti web, piattaforme di social media o risorse di terzi. Tali link sono forniti esclusivamente per comodità dell’utente.

La Fondazione non esercita alcun controllo sui contenuti, sulle informative sulla privacy o sulle prassi di tali siti web di terzi, non li avalla e non assume alcuna responsabilità in relazione agli stessi. L’utilizzo di siti web di terzi avviene a esclusivo rischio dell’utente.

7. Esclusione di garanzie

Sebbene nessun metodo di trasmissione via Internet sia completamente sicuro, la Fondazione adotta misure tecniche e organizzative ragionevoli volte a proteggere i dati personali trasmessi attraverso il Sito. Anche gli utenti sono tenuti ad adottare le opportune precauzioni nella trasmissione di informazioni per via elettronica.

Nella misura massima consentita dalla legge, la Fondazione Senabil per la Gioventù e lo Sviluppo:

Nessuna trasmissione di dati via Internet può essere garantita come sicura al 100%.

  • non garantisce che il Sito sarà ininterrotto, privo di errori o sicuro;
  • non garantisce che eventuali difetti saranno corretti;
  • non garantisce che il Sito o i relativi server siano privi di virus o di altri componenti dannosi;
  • non fornisce alcuna dichiarazione in merito all’accuratezza, all’affidabilità o alla completezza dei contenuti.

8. Limitazione di responsabilità

Nella misura massima consentita dalla legge applicabile, la Fondazione Senabil per la Gioventù e lo Sviluppo non sarà responsabile per:

Nulla di quanto previsto nei presenti Termini esclude o limita la responsabilità della Fondazione per morte o lesioni personali derivanti da propria negligenza, né per frode o dichiarazioni fraudolente.

  • danni diretti, indiretti, accidentali, speciali, consequenziali o punitivi;
  • perdita di profitti, dati, avviamento o altre perdite immateriali;
  • danni derivanti dall’utilizzo del Sito da parte dell’utente o dall’impossibilità di utilizzarlo;
  • danni derivanti da errori, omissioni, interruzioni o ritardi.

9. Manleva

L’utente si impegna a manlevare e tenere indenne la Fondazione Senabil per la Gioventù e lo Sviluppo, nonché i suoi dirigenti, amministratori, dipendenti, volontari e incaricati, da qualsiasi pretesa, responsabilità, danno, perdita, costo o spesa (incluse le spese legali) derivanti da quanto segue:

  • l’utilizzo del Sito da parte dell’utente in violazione dei presenti Termini;
  • la violazione da parte dell’utente di qualsiasi legge applicabile;
  • la violazione da parte dell’utente di diritti di terzi.

10. Modifiche ai presenti Termini

La Fondazione si riserva il diritto di modificare i presenti Termini in qualsiasi momento mediante la pubblicazione delle modifiche online. L’utilizzo continuato del Sito da parte dell’utente successivamente alla pubblicazione di eventuali modifiche costituisce accettazione dei Termini aggiornati. 11. Legge applicabile

I presenti Termini sono disciplinati dalla legge palestinese e devono essere interpretati in conformità alla stessa. Qualsiasi controversia derivante dai presenti Termini o dall’utilizzo del Sito da parte dell’utente sarà risolta in via esclusiva dinanzi ai tribunali palestinesi.

I presenti Termini di servizio devono essere letti congiuntamente all’Informativa sulla privacy e all’Informativa sui cookie, che forniscono ulteriori informazioni sul trattamento dei dati e sull’utilizzo del Sito.
